Terms and Conditions

These Terms and Conditions (“Terms”) apply to the use of the Simcoe Muskoka Building website and to inquiries, estimate requests, and services provided by Simcoe Muskoka Building (“we,” “us,” or “our”).
 

By using this website, submitting a form, requesting an estimate, or engaging our services, you agree to these Terms.
 

1. Services

Simcoe Muskoka Building provides residential construction services, which may include custom homes, additions, garage builds, renovations, and related residential construction work in Simcoe, Muskoka, Parry Sound, and surrounding areas.
 

All services are subject to availability, project fit, scheduling, and a separate written agreement where applicable.
 

2. Website Information

The information provided on this website is for general informational purposes only and does not create a binding contract unless expressly confirmed in writing.
 

Service descriptions, examples, timelines, and other website content may be updated or changed without notice.
 

3. Estimates

Any estimate provided by Simcoe Muskoka Building is based on the information available at the time, including discussions, plans, drawings, measurements, site visits, specifications, and other project details provided by the client.
 

Unless otherwise stated in writing:

  • estimates are provided for planning and review purposes

  • estimates are valid for 30 days from the date issued

  • if acceptance is delayed beyond that period, a revised estimate may be required

  • estimates may need to be updated if project details, scope, materials, timing, or site conditions change before work begins
     

4. Pricing

Pricing is based on the scope of work, material pricing, labour availability, site conditions, subcontractor pricing, and the information provided at the time of estimating.
 

Pricing may be revised before contract execution or project start if:

  • material costs increase

  • labour or subcontractor pricing changes

  • the project scope changes

  • site conditions differ from what was originally known

  • project approval is delayed

  • scheduling changes affect availability or cost

  • additional details arise through further review, planning, or site inspection
     

Once a written contract is entered into, any pricing changes must be handled in accordance with that contract and any approved change orders.
 

5. Deposits and Down Payments

A deposit or down payment may be required before scheduling, material ordering, planning, or the commencement of work.
 

Unless otherwise stated in writing, deposits or down payments may be applied toward:

  • scheduling and project coordination

  • administrative and planning work

  • permit-related preparation

  • material purchasing

  • subcontractor scheduling

  • other project-specific startup costs
     

Deposits may be non-refundable in whole or in part once project-related costs have been incurred.
 

6. Payment Terms

Payment terms will be set out in the applicable estimate, proposal, or written project agreement.
 

Unless otherwise stated in writing, Simcoe Muskoka Building may require:

  • a down payment before work is scheduled or started

  • progress payments at agreed project milestones

  • final payment at substantial completion or as otherwise agreed in writing
     

Current payment structure:

  • Down payment: To be determined by project  

  • Progress payments: To be determined by project  

  • Final payment: To be determined by project  
     

Failure to make payments when due may result in delays, rescheduling, or suspension of work.
 

7. Change Orders and Additional Work

Any work outside the original scope may require a written change order or revised estimate.
 

This includes, but is not limited to:

  • client-requested changes

  • material substitutions

  • unforeseen site conditions

  • additional work discovered during the project

  • changes to plans, finishes, or specifications
     

No additional work will be treated as included unless it is clearly confirmed in writing.
 

Where applicable, revised pricing, scope, and timing will be provided for approval before the additional work proceeds.
 

8. Timelines and Scheduling

Any timelines, scheduling windows, start dates, or completion dates provided by Simcoe Muskoka Building are estimates only unless expressly stated otherwise in writing.
 

Project timing may be affected by:

  • weather

  • permit timing

  • material availability

  • subcontractor or labour availability

  • client delays

  • change orders

  • site readiness

  • unforeseen site conditions

  • events outside our reasonable control

 

We will communicate material changes to schedule as reasonably possible.
 

9. Site Conditions and Access

The client is responsible for providing accurate project information and reasonable site access as required for estimating, planning, and construction.
 

If actual site conditions differ from what was visible, disclosed, or reasonably known at the time of estimate, scope, pricing, and timing may need to be revised.
 

10. Client Responsibilities

The client is responsible for:

  • providing accurate and complete project information

  • reviewing estimates, proposals, and project documents carefully

  • communicating requested changes promptly

  • making payments in accordance with agreed terms

  • ensuring site access and readiness where required

  • providing approvals, selections, or other decisions needed to keep the project moving
     

11. Materials and Availability

Material selection, product availability, lead times, and supplier pricing may affect project timing and cost.

If a product or material becomes unavailable, delayed, discontinued, or materially more expensive, substitute materials or revised pricing may be required.
 

12. Project Fit and Acceptance

Submitting a form or requesting an estimate does not guarantee that Simcoe Muskoka Building will accept or undertake the project.
 

All inquiries and projects are subject to review for:

  • scope

  • timing

  • service area

  • scheduling

  • suitability

  • overall project fit
     

13. Third-Party Services

From time to time, Simcoe Muskoka Building may rely on subcontractors, suppliers, trades, or third-party service providers in connection with a project. Their availability, lead times, pricing, and performance may affect scheduling and delivery.
 

14. Intellectual Property

All website content, including text, graphics, branding, images, and layout, is owned by or licensed to Simcoe Muskoka Building and may not be copied, reproduced, or used without permission.
 

15. Privacy

Your use of this website and any personal information you provide are also subject to our Privacy Policy.
 

16. Limitation of Liability

To the fullest extent permitted by law, Simcoe Muskoka Building is not liable for indirect, incidental, special, or consequential damages arising from the use of this website or from delays, material shortages, supplier issues, weather, or other circumstances outside our reasonable control.
 

17. Governing Law

These Terms are governed by the laws of the Province of Ontario and the applicable laws of Canada.
